The Secretary General of the Polisario Front, Brahim Ghali, received on Tuesday night, at about 21:30 hours, the voluntary discharge from hospital by the medical team that has treated him since last April, suffering from coronavirus in a very serious condition. Ghali was scheduled to leave Spain for Algeria in the early hours of Tuesday morning, from Pamplona airport, in a civilian plane chartered by the Algerian government. 

The announcement of Ghali's departure from Spain was made by the Minister of Transport, José Luis Ábalos, while he was being interviewed on a television program. The Spanish Ministry of Foreign Affairs issued a statement confirming that Brahim Ghali was leaving Spain, that Morocco had been informed of this circumstance through diplomatic channels, and that the departure was carried out with all the corresponding permits following the decision of the judge of the Audiencia Nacional, Santiago Pedraz, not to adopt precautionary measures or provisional detention as requested by the prosecution for crimes of genocide, torture and crimes against humanity in the Tindouf camps. 

In the order issued by the judge, after two hours of telematic appearance of Brahim Ghali from the hospital of San Pedro de Logroño, it is stated that there is no risk of flight and that both the judge and the prosecution understood that there was no evidence, apart from the account of the complaints, of the facts of which he was accused.

The judge indicates that "the report of the prosecution (which apart from its granted power has been questioned) has not provided even indicative elements (the statements of the witnesses in the case have no corroborative evidence and from them there is no participation in the facts of the investigated), which support the existence of sufficient grounds to believe him responsible for any crime; not being enough, obviously, to agree personal precautionary measures to indicate that Ghali entered Spain illegally".

The presence of the leader of the Polisario Front in Spain has been one of the key elements that have provoked a serious crisis in the relations between Spain and Morocco, which has accused the Government of Pedro Sanchez of not having informed nor given explanations of the decision to receive for humanitarian reasons an enemy of Morocco, considered a war criminal.
