The Decree on recruitment with preference for Moroccan origin in the public sector will enter into force in September

After months of debate in Parliament since its presentation as a bill in December 2022, the decree, which was published in the Official State Gazette (BOE) on 9 March, is now a reality. The Rabat administration's labour achievements for the service sector have taken shape and will become effective in September 2023. This is because in the North African country's law, the law comes into force on the first day of the sixth month after its publication. The decree is 2.22.431 concerning the public concert. 

Among the government's wishes is above all the confidence and security of the citizen, who, with this new law, will be favoured with respect to foreigners in terms of public contracts. In addition to national workers, companies and SMEs, the self-employed and public cooperatives will also join, and their conditions will be unified, which will bring more fiscal and economic benefits to all of them. Government institutions anticipate that, when combined with Rabat's low-tax initiatives, the Kingdom's economic base will be strengthened, allowing for faster and higher growth at all levels.

Government spokesman Mustapha Baitas, shortly after the new reform was approved, told the press that "it was necessary" and that the decree follows the path of the Kingdom's aspirations, which since 2013 has been managing a reform based on the growth of the national industrial fabric to increase production, economic growth rates and exports, and adapt to current standards and new needs such as investment in R&D and new technologies. 

With this measure already included in the BOE, the aim is to "take a leap forward that encourages public managers to choose the company with the best offer to draw up projects and avoid problems", in the words of the minister delegate in charge of the Budget, Fouzi Lekjaa. Furthermore, during the press conference that followed the approval in the Council of the Government in December 2022, the minister reviewed all the measures with the attendees so that businessmen and the press who attended the event could ask questions and understand the functioning of everything that is included in the new Decree Law.

The increase in facilities for Moroccan companies is definitely a fact. In addition, the Decree also exhibits a series of definitions and explanations that refer to the tightening of the integration of Moroccan workers in public companies, as opposed to workers who do not have the Alawi nationality, which means a consolidation of the sector that goes beyond the dimensions of sustainable development, socio-economic and environmental. Among the industries that will benefit the most are traditional crafts, local processing and any production carried out on Moroccan territory, thanks to the low taxation that they will bear according to the 2022-2025 national review plan.
